Dallas DMV Hearings
A Dallas the DMV hearing is a separate administrative hearing which takes place only at the request of the Petitioner or his/her lawyer. The DMV automatically revokes one’s license in the State of Dallas if it receives notification from the arresting officer that the individual failed a Blood or Breath test. The hearing must be requested within 90 days of receiving notification from the Department of Motor Vehicles that the license is revokedOnce a hearing is a requested, the revocation period is “stayed” or stopped until a hearing takes place. The Dallas Department of Motor Vehicles issues the individual a temporary license granting full driving privileges until the hearing takes place. Every DUI case is different, but DMV hearings are very difficult to win because a Dallas Driver’s License is a “Privileged License”. This means that no one has a “right” to have a Dallas Driver’s License. As a result, the burden of proof for the government to remove this privilege is very low as compared to a criminal court proceeding where the government has the burden to proof driving under the influence beyond a reasonable doubt.
